Virtual Desktop Console: Terms of Service

This Service Agreement (“Service Agreement”) governs your use of Spaceport Consulting’s hosting and virtualized desktop services (the “Services”). By accessing the Virtual Desktop Console, you agree to be bound by these terms.
- Description of Services
- Virtual Private Server (VPS) & Virtual Desktop: Our services place your instance within a server environment shared with other customers. However, you are granted full administrative (root) and/or administrator access and complete control over the configuration of your virtual instance.
- Third-Party Software: The Services may include software, widgets, or applications (“Software”) owned or licensed by third parties. Your use of such Software is subject to their respective license agreements in addition to this Service Agreement. Spaceport Consulting disclaims all liability regarding third-party Software and requires you to indemnify us against any claims arising from your use or misuse of it.
- Licensing & Compliance
- Operating System (OS) Licenses: While the Virtual Desktop Console provides the infrastructure and administrative access required to manage your instance, you are solely responsible for obtaining, maintaining, and ensuring the legal compliance of all Operating System (OS) licenses and software licenses used within your instance. Spaceport Consulting is not a reseller of OS licenses, and we do not guarantee the legality of any software installed by the user.
- Software Legality: You represent that you have the legal right to use all software, data, and materials uploaded to or running within your instance.
- Account Management & Infrastructure
- Server Migrations: To maintain network health, we may migrate servers as a normal course of business. You acknowledge that even with a dedicated IP, you may be assigned a different IP address following a migration. We do not warrant the consistent availability of any specific IP number.
- IP Address Usage & Reclamation: To prevent resource hoarding, you are required to utilize at least ninety percent (90%) of your purchased IP addresses within thirty (30) days of assignment. Spaceport Consulting reserves the right to reclaim any unused IP addresses after this period.
- Storage Capacity: The total usable storage capacity may differ from the advertised capacity due to the overhead required for operating systems, system files, and supporting architecture.
- Termination & Data Responsibility: Upon expiration or termination of your Services:
- You must discontinue all use of the Services and relinquish all assigned IP addresses and server names.
and must point your DNS away from our servers. - Data Migration: You are solely responsible for moving all website or server content off our servers prior to termination. Spaceport Consulting will not perform FTP transfers or manual migrations on your behalf.
- Deletion: Failure to migrate data before cancellation will result in the permanent deletion of all such content; we will be unable to provide copies of deleted data.
- You must discontinue all use of the Services and relinquish all assigned IP addresses and server names.
- Acceptable Use & Prohibited Activities
To protect our network and all users, the following activities are strictly prohibited:
- Network Abuse: You may not use our servers as a source, intermediary, or destination for mail bombs, packet flooding, packet corruption, Denial of Service (DoS) attacks, or any other activity that threatens the stability of the Spaceport Consulting network.
- Security Breaches: Server hacking, unauthorized access, or using your instance as an anonymous gateway is prohibited. We reserve the right to remove any site containing information about hacking or links to such content.
- Resource Exhaustion: You may not run software or scripts that cause server loads to exceed a reasonable level, as determined by us.
- Crypto Mining: The use of our equipment for cryptocurrency mining is strictly prohibited. If mining activity is detected, we will take immediate action to limit processing speeds and/or terminate your service without refund.
- Malicious Content: We reserve the right to scan your hosted account for malware. If malicious content is discovered, we may remove it at our discretion to protect the integrity of our network.
- User Obligations & Security
- Backup Responsibility: You are solely responsible for maintaining independent, regular, and secure archival and backup copies of your server content. Our servers are not an archive service; Spaceport Consulting shall have no liability for the loss, damage, or destruction of your data.
- Compliance (PCI/HIPAA): The Services are not intended to provide a PCI-compliant or HIPAA-compliant environment and should not be used as such.
- Forensic Access: You hereby authorize Spaceport Consulting to log into your server for purposes of providing support, installing managed backups, or conducting forensic analysis in the event of a security compromise.
- Service Uptime Guarantee
We offer a Service Uptime Guarantee of 99.9% per month.
- Credits: If we fail to meet this guarantee (as determined solely by us), you may request a service credit equal to 5% of your monthly hosting fee for that month. Credits are applicable toward future purchases and exclude taxes.
- Exclusions: This guarantee does not apply to interruptions caused by:
- Scheduled maintenance or repairs.
- Issues arising from your custom scripting, coding, or third-party applications.
- Outages affecting specific protocols (e.g., FTP/Email) that do not affect the primary website appearance.
- Causes beyond our reasonable control or foreseeable circumstances.
- Reselling Prohibitions
Our VPS and Hosting Services are provided for your direct use as a customer and may not be resold under the name of another person or company without express written authorization from Spaceport Consulting.
